Automatic
Fines:
- The
Board of Directors takes the personal safety, welfare,
financial investment and shared community liability
of our Association very seriously. Because of this,
the Board has implemented AUTOMATIC Fine
Assessments for matters that have an immediate impact
on the safety, welfare and liability of the community.
- An
automatic fine of $50 will be assessed for gross violations
of the Rules and Regulations. These included, but
are not limited to: glassware inside the pool fence
areas; the riding of bicycles, motorcycles, mopeds,
motorized scooters, skateboards, skates, roller-blades,
go-carts, or similar vehicles, etc. in the common
area; excessive speed in driveways, parking lots,
etc.; failure to yield the right of way to pedestrians;
vandalism; deliberate destruction of Association property,
including plants, trees, shrubs, etc.; and graffiti.
- In
addition, an automatic fine of $50 will be assessed
for dumping excessive or non-household trash (such
as furniture, appliances, mattresses, sofas, industrial
trash, etc.) PLUS
cost of removal.

| Board
Action On Violations and Right To Appeal |
| THE
HOMEOWNER CITED IN A "NOTICE OF VIOLATION" HAS
THE RIGHT TO APPEAL THROUGH A HEARING BEFORE THE BOARD
OF DIRECTORS. APPLICATION FOR SUCH A HEARING MUST BE MADE
IN WRITING TO THE BOARD THROUGH THE MANAGEMENT COMPANY
WITHIN TEN (10) WORKING DAYS OF ISSUANCE OF THE VIOLATION
NOTICE.
Hearing Request Forms are available upon request from
the Management Company. Hearing
Request Forms must be completed
and received by the management company no later than 5:00
p.m. the Friday before the regularly scheduled Board Meeting,
or will be scheduled for the next month's meeting. The
Management Company will advise of the date, time and place
of the hearing. Failure to apply for a hearing within
the allotted time will constitute an admission of guilt
and no further appeals may be made. Based on the facts
presented and representation made by the person cited,
the Board may, at its discretion: |
A.
Levy a fine assessment in accordance with the schedule
above or initiate legal action, depending upon the
nature and circumstances of the violation;

B.
Grant an extension of the time allowed to correct
the violation, in which case the Board will also determine
the action to be taken in the event it is not corrected;
|
C.
Dismiss the action; or
|
D.
If the homeowner contesting the violation fails to
appear at the regularly scheduled meeting, an applicable
assessment will be charged to their account.

| The
homeowner cited will be given a written notice of the
action adopted by the Board. Fine assessments are payable
upon receipt of the regularly scheduled billing statement
following the notice of action. Delinquent payments will
be subjected to enforcement by lien proceedings. |
