Description
of Land Improvements |
| Section
1. Condominium Plan Best Authority
The
following description is intended for information purposes
only and in the event of any conflict between this description
and the Condominium Plan, the Condominium Plan shall be
deemed to conclusively control. |
| Section
2. Property Description
The
property consists of Parcel 1 of Map 79-756, City of Orange,
County of Orange, State of California, as per Map recorded
in the Office of the County Recorded of said County. There
hereinabove described real property consists of an irregularly-shaped
plot, approximately 3.97 acres in Phase I. Construction
has been completed on said land and improvements, consisting
basically of eight (8) buildings, housing a total of seventy-four
(74) units. Phase II, Parcel 2 of Map 79-756 is planned
to consist of seven (7) buildings, housing a total of
seventy-eight (78) units on approximately 2.80 acres of
land. Phase III, Parcel 3 of Map 79-756 is planned to
consist of five (5) buildings, housing a total of sixty
(60) units on approximately 2.66 acres of land. |
| Section
3. Description of Individual Condominium
Each
condominium within the project which shall be offered
for sale, shall consist of a fee simple interest in a
particular unit, together with an undivided fractional
interest as a tenant-in-common in and to the Common Area,
as set forth on Exhibit "D"
hereto and made a part hereof. |

4. Parking
Each
purchaser of a condominium shall be granted by Declarant
in the deed to said purchaser, an exclusive easement to
and the exclusive right to use, no less that one (1) parking
space as shown on the Condominium Plan, Exhibit "A"
hereto and made a part hereof. All parking spaces shall
be used only by the owners and there lessees and all such
persons shall be required to have and keep in force, property
damage insurance on their automobiles and further the
parking spaces easement owner shall be responsible for
the repair, maintenance and upkeep of the internal walls
of the parking easement. Any parking spaces remaining
unconveyed by Declarant after the close of the last escrow
in Phase III, shall be quitclaim deeded to the Association
for guest parking. |
| Section
5. Easements
Each
owner shall receive, as an incidence of conveyance of
his unit, a non-exclusive easement appurtenant thereto,
for ingress, egress and support over, across and though
the Common Area and every portion of any unit within the
project required for the structural support of the building

of the building within which said unit located. In the
event any portion of the Common Area encroaches upon a
unit,. or any unit encroaches upon the Common Area as
a result of construction, reconstruction, repair, shifting,
settlement or movement of any portion of the project,
a valid easement for the encroachment and for the maintenance
of same shall exist so long as the encroachment exists.
